Sheffield Magistrates' Court Solicitors
Drink driving is a serious motoring offence that can result in immediate custody. Despite this, it is one of the most common motoring offences committed on roads in Sheffield. Drink and drug driving is an all-year-round problem on Sheffield's roads - and, everyday, officers stop drivers who are behind the wheel in an unfit state.
South Yorkshire Police take a no nonsense, zero-tolerance approach to these offences. In one recent article, Sheffield Constabulary warned there was "no safe limit" when driving a vehicle. It is for this reason that M.A.J Law regularly defend drink driving cases in and around South Yorkshire. M.A.J Law has first hand experience of Sheffield Magistrates' Court. We have represented clients in this part of the country for over 10 years.
Drink Driving Sentence - Sheffield
Drink driving disqualifications for a first time offender range from 12 months to three years (longer if you have previous convictions or have caused injury). It does not matter if you need your vehicle for work or to support your family, the court will still have to ban you. Drink driving mitigation can be important and may help to reduce the driving ban or avoid more serious penalties like community service or prison. You can read more about mitigation on our Mitigation Page. The only way to avoid a driving ban is to win the case (avoid a conviction). This is not as difficult as it may sound and involves challenging the accuracy of the evidence against you.
How to get off a drink driving charge
There are four common ways to win a drink driving case;
- Police procedure
- Reliability of the result
- Prosecution disclosure
- Witness attendance
I do not intend to explain what each of these defences relate to, but I would encourage you to call us directly to discuss your case. We offer free initial advice to anyone charged/suspected of drink driving and we regularly attend Sheffield Magistrates' Court to represent our clients. For more information about drink driving defences and loopholes, please see this page.
